Eminent Domain / Condemnation
The power of the government to take private property and convert it into public use. The Fifth Amendment provides that the government may only exercise the power of eminent domain if it provides just compensation to the property owner.
Inverse Condemnation
The taking of property by a government agency which so greatly damages the use of a parcel of property that it is the equivalent of condemnation of the entire property. The process of eminent domain was not used and just compensation was not paid.
Property Rights
The Fifth Amendment protects the right to private property, it states a person may not be deprived of property by the government without due process of law, or fair procedures.

What is eminent domain?
Eminent domain is the government's power to take private land for public use . The power of eminent domain is defined by the "Takings Clause" of the Fifth Amendment to the U.S. Constitution, which prohibits the federal government from taking private property for public use "without just compensation."

The approximate two-mile new roadway extension will continue Phase I which is currently being constructed. Phase II will be initially constructed as an undivided two-lane roadway.
Right of way acquisition has begun and construction is anticipated to start at the end of 2025.
